Terms of Use
1. Scope
These terms govern your use of the GritRace iOS app (the “App”), the website at gritrace.app (the “Site”), and the feedback platform at feedback.gritrace.app (the “Feedback Platform”). Together: the “Services”. By using any of the Services you agree to these terms.

2. The iOS app
The App is distributed exclusively through Apple's App Store. The App Store's standard end-user licence agreement (Apple EULA) governs your right to install and use the App on devices you own or control. Where Apple's EULA conflicts with these terms, Apple's EULA prevails for the App itself.
You may use the App for personal, non-commercial purposes. You may not reverse-engineer, decompile, redistribute, or sublicense the App except as expressly permitted by applicable law.
3. Purchases & refunds
One-time and subscription purchases are processed by Apple via the App Store. Refunds are also handled by Apple, in accordance with their refund policy.
EU consumers retain their statutory 14-day right of withdrawal under § 312g BGB for digital content, except where you have expressly consented to immediate performance and acknowledged that the right of withdrawal lapses upon download (which is the standard App Store flow).
4. The feedback platform
You can use the Feedback Platform to submit ideas, comment, vote, and follow the public roadmap. Sign-in via magic-link email or, optionally, Google or Apple OAuth.
You may not:
- Submit content that is unlawful, defamatory, obscene, harassing, or that infringes third-party rights;
- Submit personal data of other people without their consent;
- Use the platform to advertise unrelated products or services;
- Attempt to circumvent technical limits, including the spam-prevention rate limits;
- Run automated processes (scrapers, bots) against the platform without prior written permission.
We may remove content and suspend accounts that violate these rules. We aim to do so transparently — in most cases we will tell you why.
5. User content
You retain ownership of the posts and comments you submit. By submitting content to the Feedback Platform, you grant us a worldwide, royalty-free, non-exclusive licence to host, display, and excerpt that content for the purpose of operating the platform and quoting community feedback in product communications (e.g. release notes, marketing).
You can delete your own posts and comments at any time. Deletion removes the content from the public platform; we may retain backup copies for up to 30 days for operational reasons before they are overwritten.
By posting content you affirm that you have the right to do so and that the content does not violate the rules in section 4.
6. Availability
The Services are provided on a best-effort basis. We aim for high uptime but do not commit to a specific service-level agreement. Maintenance windows may cause brief unavailability and will be announced when planned.
7. Warranty
For paid features of the App, statutory warranty rules apply (in Germany, §§ 327 ff. BGB for digital products). For the Site and the Feedback Platform, which are provided free of charge, no warranty for any particular performance or fitness for purpose is given beyond what mandatory law requires.
8. Liability
We are liable without limitation for:
- Damages caused by intent or gross negligence;
- Personal injury (life, body, health);
- Product liability under the Produkthaftungsgesetz;
- Breach of guarantees we have explicitly given.
For ordinary negligence, we are only liable for a breach of essential contractual obligations (i.e. obligations whose fulfilment is essential to the proper performance of the contract and on whose compliance you may regularly rely). In such cases liability is limited to the foreseeable damage typical for this kind of contract.
Any further liability is excluded to the extent permitted by law. The limitations apply equally to the personal liability of our employees, representatives, and agents.
Race-day note: GritRace is an aid for tracking races and training. Pace, splits, and station signals are estimates based on sensor data. They should not substitute for official race timing or medical advice.
9. Changes to these terms
We may update these terms when the Services change, when we add new features, or when the law requires it. The current version is always available at this URL. Material changes will be announced on the feedback board and, where you have an account, by email at least 30 days before they take effect.
If you do not agree to a change, you may stop using the Services and (for the Feedback Platform) delete your account.
10. Governing law & venue
These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer-protection rules of the country of your habitual residence remain unaffected.
If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is Villingen-Schwenningen, Germany.
